Durch die Nutzung von NearSpotio ("die App") stimmst du den folgenden Nutzungsbedingungen zu. Bitte lies sie sorgfältig durch.
1. Persönlicher Gebrauch
Die App ist ausschließlich für den persönlichen, nicht-kommerziellen Gebrauch bestimmt. Du darfst die App nutzen, um Points of Interest (POIs) entlang deiner Routen zu finden, GPX-Dateien mit POIs zu exportieren und die bereitgestellten Informationen für deine eigenen Touren zu verwenden.
2. Kommerzielle Nutzung untersagt
Ohne ausdrückliche schriftliche Genehmigung ist es untersagt:
- Die App oder ihre Ergebnisse (exportierte GPX-Dateien, POI-Daten) kommerziell zu nutzen
- Exportierte Daten entgeltlich an Dritte weiterzuverkaufen oder zu verteilen
- Einen Dienst auf Basis der App-Daten anzubieten (z.B. kostenpflichtige GPX-Konvertierung)
- Die App systematisch oder automatisiert auszulesen (Scraping)
3. Fair-Use-Grenzen
Um die faire Nutzung sicherzustellen, gelten folgende Export-Beschränkungen:
- Testphase für neue Nutzer: 12 Tage volle POI-Sichtbarkeit und 12 kostenlose Pro-Exports
- Maximal 24 Exports pro Tag (Pro-Version)
- In den ersten 2 Stunden nach dem Kauf maximal 10 Exports
Diese Limits sind für den normalen persönlichen Gebrauch (z.B. Bikepacking, Radtouren) mehr als ausreichend.
4. Haftung
Die in der App angezeigten POI-Daten stammen aus frei zugänglichen Quellen (insbesondere OpenStreetMap) und wurden automatisiert übernommen. Wir können nicht gewährleisten, dass die Informationen vollständig, korrekt, aktuell oder vor Ort tatsächlich vorhanden sind. Die Nutzung erfolgt auf eigene Verantwortung.
Hinweis zur Datengenauigkeit: Insbesondere kann nicht garantiert werden, dass eine als „Trinkwasser" gekennzeichnete Stelle tatsächlich trinkbares Wasser führt, dass eine angezeigte Apotheke, Bäckerei oder ein Geldautomat tatsächlich existiert, geöffnet oder zugänglich ist, oder dass eine Fahrradreparaturstation die benötigten Leistungen anbietet. Die Daten können veraltet, unvollständig oder fehlerhaft sein. Die POI-Daten auf deinem Gerät werden regelmäßig über automatische Updates aktualisiert — in der Regel mindestens einmal im Monat — wobei neue POIs hinzugefügt, geänderte aktualisiert und entfernte entfernt werden. Trotz dieser regelmäßigen Aktualisierungen kann keine Gewähr für die Aktualität oder Richtigkeit der Daten übernommen werden. Es liegt in der alleinigen Verantwortung der Nutzerin bzw. des Nutzers, die Gegebenheiten vor Ort eigenständig zu überprüfen und zu beurteilen.
Gerätekompatibilität: NearSpotio exportiert POI-Daten im standardisierten GPX-Format. Die Kompatibilität mit GPS-Geräten und Drittanbieter-Apps (z. B. Garmin, Wahoo, COROS, Suunto) kann aufgrund der Vielzahl an Gerätemodellen, Firmwareversionen und App-Versionen nicht garantiert werden. Genau aus diesem Grund bietet NearSpotio eine kostenlose Testphase mit 12 Tagen voller POI-Sichtbarkeit und 12 vollständigen Route-Exports, um die Kompatibilität mit dem eigenen Setup vor dem Kauf zu testen.
Unsere Haftung für Schäden, die aus der Nutzung der App oder ihrer Daten entstehen, ist wie folgt geregelt:
- Bei Vorsatz und grober Fahrlässigkeit haften wir unbeschränkt.
- Bei Personenschäden (Verletzung von Leben, Körper oder Gesundheit) haften wir unbeschränkt, unabhängig vom Verschuldensgrad.
- Bei leichter Fahrlässigkeit haften wir nur bei Verletzung einer wesentlichen Vertragspflicht (Kardinalpflicht). In diesem Fall ist die Haftung auf den vertragstypischen, vorhersehbaren Schaden begrenzt.
- Die Haftung für mittelbare Schäden, Folgeschäden und entgangenen Gewinn bei leichter Fahrlässigkeit ist ausgeschlossen.
Diese Haftungsregelung gilt auch zugunsten unserer Erfüllungsgehilfen. Zwingende gesetzliche Haftungsansprüche bleiben unberührt.
5. Geistiges Eigentum
Die App, ihr Design, ihre Funktionen und die zugrunde liegende Software sind urheberrechtlich geschützt. Das Kopieren, Dekompilieren oder Reverse-Engineering der App ist untersagt.
6. In-App-Käufe & Digitale Inhalte
Die Pro-Version wird als einmaliger In-App-Kauf angeboten. Es handelt sich um digitale Inhalte, die nicht auf einem körperlichen Datenträger geliefert werden.
Kostenlose Testphase: Neue Nutzer erhalten eine einmalige, gerätegebundene Testphase: 12 Tage volle POI-Sichtbarkeit (alle POIs mit 100% Opacity) und 12 kostenlose Pro-Exports. Nach Ablauf fällt der Nutzer in den kostenlosen Modus zurück. Die Testphase kann nicht zurückgesetzt oder verlängert werden.
Zahlungsabwicklung: Der Kauf wird ausschließlich über den jeweiligen App Store abgewickelt – Google Play (Google Ireland Limited) bzw. Apple App Store (Apple Distribution International Ltd.). NearSpotio hat keinen Zugriff auf deine Zahlungsdaten. Es gelten die Zahlungs- und Rückgabebedingungen des jeweiligen Stores.
Widerrufsrecht: Mit dem Kauf stimmst du zu, dass die Bereitstellung der digitalen Inhalte sofort beginnt. Du wirst darauf hingewiesen, dass du mit Beginn der Ausführung dein Widerrufsrecht gemäß § 18 Abs. 1 Z 11 FAGG (österreichisches Fern- und Auswärtsgeschäfte-Gesetz) bzw. Art. 16 lit. m der EU-Richtlinie 2011/83/EU verlierst. Die Pro-Funktionen stehen dir nach dem Kauf sofort und dauerhaft zur Verfügung.
7. Änderungen
Wir behalten uns das Recht vor, diese Nutzungsbedingungen jederzeit zu ändern. Wesentliche Änderungen werden innerhalb der App mitgeteilt. Die fortgesetzte Nutzung der App nach einer Änderung gilt als Zustimmung.
8. Anwendbares Recht & Gerichtsstand
Es gilt das Recht der Republik Österreich unter Ausschluss des UN-Kaufrechts (CISG) und der Verweisungsnormen des internationalen Privatrechts.
Zwingende Verbraucherschutzbestimmungen des Staates, in dem du deinen gewöhnlichen Aufenthalt hast, bleiben hiervon unberührt (Art. 6 Abs. 2 Rom-I-Verordnung, VO (EG) Nr. 593/2008). Dir stehen daher in jedem Fall die Schutzrechte zu, die dir das Recht deines Wohnsitzstaates zwingend gewährt.
Gerichtsstand ist, soweit gesetzlich zulässig, Innsbruck, Österreich. Für Verbraucher im Sinne des Konsumentenschutzgesetzes (KSchG) gilt der gesetzliche Gerichtsstand.

By using NearSpotio ("the App"), you agree to the following terms of use. Please read them carefully.
1. Personal Use
The App is intended exclusively for personal, non-commercial use. You may use the App to find points of interest (POIs) along your routes, export GPX files with POIs, and use the provided information for your own tours.
2. Commercial Use Prohibited
Without express written permission, it is prohibited to:
- Use the App or its results (exported GPX files, POI data) commercially
- Resell or distribute exported data to third parties for payment
- Offer a service based on the App's data (e.g. paid GPX conversion)
- Systematically or automatically extract data from the App (scraping)
3. Fair Use Limits
To ensure fair usage, the following export restrictions apply:
- Trial period for new users: 12 days of full POI visibility and 12 free pro exports
- Maximum of 24 exports per day (Pro version)
- Maximum of 10 exports within the first 2 hours after purchase
These limits are more than sufficient for normal personal use (e.g. bikepacking, cycling tours).
4. Liability
The POI data displayed in the App originates from freely accessible sources (in particular OpenStreetMap) and has been imported automatically. We cannot guarantee that the information is complete, correct, up-to-date, or actually present on site. Use is at your own risk.
Data accuracy notice: In particular, there is no guarantee that a location marked as "drinking water" actually provides potable water, that a displayed pharmacy, bakery or ATM actually exists, is open or accessible, or that a bicycle repair station offers the services needed. The data may be outdated, incomplete or inaccurate. The POI data on your device is updated regularly via automatic updates — typically at least once a month — adding new POIs, updating changed ones and removing deleted ones. Despite these regular updates, no guarantee can be given regarding the accuracy or timeliness of the data. It is the sole responsibility of the user to independently verify and assess the conditions on site.
Device compatibility: NearSpotio exports POI data in the standardised GPX format. Compatibility with GPS devices and third-party apps (e.g. Garmin, Wahoo, COROS, Suunto) cannot be guaranteed due to the wide variety of device models, firmware versions and app versions. This is precisely why NearSpotio offers a free trial period with 12 days of full POI visibility and 12 complete route exports, allowing you to test compatibility with your own setup before purchasing.
Our liability for damages arising from the use of the App or its data is governed as follows:
- In cases of intent and gross negligence, we are liable without limitation.
- For personal injury (harm to life, body, or health), we are liable without limitation, regardless of the degree of fault.
- In cases of slight negligence, we are only liable for breach of a material contractual obligation (cardinal obligation). In such cases, liability is limited to the foreseeable, contract-typical damage.
- Liability for indirect damages, consequential damages, and lost profits in cases of slight negligence is excluded.
This limitation of liability also applies in favour of our vicarious agents. Mandatory statutory liability claims remain unaffected.
5. Intellectual Property
The App, its design, features, and underlying software are protected by copyright. Copying, decompiling, or reverse-engineering the App is prohibited.
6. In-App Purchases & Digital Content
The Pro version is offered as a one-time in-app purchase. It constitutes digital content that is not supplied on a tangible medium.
Free trial period: New users receive a one-time, device-bound trial period: 12 days of full POI visibility (all POIs at 100% opacity) and 12 free pro exports. After expiry, the user reverts to the free mode. The trial period cannot be reset or extended.
Payment processing: The purchase is processed exclusively through the respective app store – Google Play (Google Ireland Limited) or Apple App Store (Apple Distribution International Ltd.). NearSpotio does not have access to your payment information. The payment and refund policies of the respective store apply.
Right of withdrawal: By making the purchase, you consent to the immediate delivery of the digital content. You acknowledge that you thereby lose your right of withdrawal pursuant to § 18(1)(11) FAGG (Austrian Distance and Off-Premises Contracts Act) and Art. 16(m) of EU Directive 2011/83/EU. The Pro features are available to you immediately and permanently after purchase.
7. Changes
We reserve the right to modify these terms of use at any time. Significant changes will be communicated within the App. Continued use of the App after a change constitutes acceptance.
8. Governing Law & Jurisdiction
These terms are governed by the laws of the Republic of Austria, excluding the UN Convention on Contracts for the International Sale of Goods (CISG) and the conflict-of-law rules of private international law.
Mandatory consumer protection provisions of the country in which you have your habitual residence shall remain unaffected (Art. 6(2) of the Rome I Regulation, Regulation (EC) No 593/2008). You therefore retain any mandatory protective rights granted to you by the laws of your country of residence.
The place of jurisdiction is Innsbruck, Austria, to the extent permitted by law. For consumers within the meaning of the Austrian Consumer Protection Act (KSchG), the statutory place of jurisdiction applies.
